The 9th U.S. Circuit Court of Appeals was center stage for the U.S. vs Arizona battle over the state’s controversial immigration bill SB 1070.
The U.S. Justice Department that brought suit against Arizona contends that only the U.S. government can make immigration law. Arizona says you aren’t doing your job so we will. The current Governor of Arizona, Jan Brewer, who signed the bill was present as was the bills author, Republican State Senator Russell Pearce. Interestingly two of the three judges, Carlos T. Bea and Richard A. Paez are Hispanic.
The justices appeared through their questioning ready to allow Arizona to ask someone they stop if they are here illegally. However, the justices don’t appear ready to allow Arizona to charge someone with a state crime if they are here working illegally or not carrying certain federal documents. It is unknown when the judges will rule on this case.
