The grandparents of a boy who died after allegedly being beaten by his mother’s boyfriend while she did nothing to stop it says employees with multiple agencies failed to protect their grandson.
Robert and Sandra Fernandez filed a compliant on Tuesday against a number of agencies that had been tasked with protecting 8-year-old Gabriel Fernandez.
Gabriel died on May 24 after suffering a broken skull and ribs. It is believed his mother, 29-year-old Pearl Fernandez allowed her boyfriend 32-year-old Isauro Aguirre continuously tortured the boy.
Along with the injuries that ultimately led to his death, doctors found cigarette burns, bruises, as well as BB gun pellets in his lungs and groin.
In the lawsuit filed this week, Gabriel’s grandparents claim the Palmdale Unified School District and the Los Angeles County Department of Children and Family Services (DCFS). Specific social workers area also names along with a welfare fraud investigator.
DCFS and the fraud investigator are accused of breaching their “mandatory duties.” The It goes on to say the investigator was under moral obligation to report the suspected abuse reported by Gabriel’s grandparents.. The grandparents, however, claim that rather than report the violence, the investigator asked the boy’s mother out on a date.
The lawsuit also claims various agencies failed to properly investigate the 64 reports of abuse against the 8-year-old.
