Selena Gomez and The Scene are among those named in a lawsuit filed claiming their song “A Year Without Rain” was a rip off another band’s song.

Tom Luce, Brian Kroll, Matt Blackett and Lawrence Riggs of the band Luce, the plaintiffs in the case, say Gomez and her band (along with song writers Lindy Robbins and Toby Gad) ripped off their song “Buy A Dog”.

According to the lawsuit, Luce’s song was often played on Sirius/XM radio and various other outlets in 2005, long before Gomez and her band were even created. The plaintiffs state “A Year Without Rain” and “Buy A Dog” have melodies in the chorus that are nearly identical.

The lawsuit alleges that Gomez’s song, with was the title track off her second studio album, infringes on their copyright and are suing for $1 million.
