Border Patrol Agent Charged with Sexually Assaulting Undocumented Immigrant

Texas Border Patrol Agent Philip Westerman has been arrested on charges he sexually assaulted an undocumented immigrant while she was hospitalized.

Agent Westerman, 42, has been a Border Patrol agent for a little over three years and patrolled the South Texas, Falfurrias station.  He was guarding the unidentified undocumented woman at the Christus Spohn Hospital, who was receiving medical attention for an arm injury since April 18.

It is border patrol protocol for agents to guard undocumented immigrants when they are receiving medical treatment and until they are formally arrested for illegal entry into the U.S. 

Reportedly the incident occurred on April 28 when the victim found Westerman violating her with his fingers and then proceeded to masturbate in front of her.  The victim found Westerman’s DNA on paper towels he threw out in her bathroom – that is when she decided to report the incident.

Westerman challenged the woman’s version of events and claimed he had masturbated in the victim’s hospital bathroom because the victim had aroused him.

Westerman was booked on charges of second-degree sexual assault with a $150,000 bond.  The agent is currently on administrative leave from his Border Patrol job.
