Rafael Leao of Miami-Dade is accused of choking his 4-year-old daughter during a supervised visit and after losing custody due to child molestation charges.

Leao, 30-year-old was visiting his daughter inside a family services center with a social worker present, it was the social worker that heard the screams of the little girl “He’s choking me!”  Apparently the social worker went to answer a phone when the incident happened.

Leao had lost custody due to sexual abuse charges and was to undergo parenting classes, seek counseling and stay on his psychiatric medications. 

The little girl, after being interviewed by police that were called to investigate, also alleges her father tried to fondle her. 

The Department of Children & Families is asking Judge Maria Sampedro-Iglesia to reconsider her decision allowing Leao, who is bipolar, to visit with his daughter.
